These Terms of Service ("Terms") govern your use of the FlowerCare website at https://flower-care.top ("Website") and our plant care application ("App"). By accessing or using our Website or App, you agree to be bound by these Terms.
If you do not agree with any part of these Terms, please do not use our services.
1. Description of Service
FlowerCare is an intelligent plant care application that helps you track, monitor, and care for your indoor plants. Our services include:
- AI-powered plant identification from photos
- Personalized care reminders and schedules
- Weekly health check monitoring with AI analysis
- Room-based plant organization
- Growth tracking and photo history
- Offline functionality with optional cloud backup
- FlowerCare Pro subscription with advanced features
2. Account Registration and Security
To use FlowerCare, you may create an account using:
- Email address with magic link authentication
- Google OAuth sign-in
You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized access
We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.
3. Free and Paid Services
3.1 Free Service
FlowerCare offers a free tier that includes:
- Unlimited plants and rooms
- Smart care reminders
- Plant identification
- Weekly health checks
- Basic timeline and history
- Offline functionality
3.2 FlowerCare Pro Subscription
FlowerCare Pro is a paid subscription service ($4.99/month) that includes:
- All free features
- Advanced AI coaching and detailed plant care advice
- Unlimited photo history
- Growth timelapses
- Cloud backup and sync across devices
- Family sharing capabilities
- Priority health alerts
- Data export functionality
- Sensor integration support
- 14-day free trial (no credit card required for trial)
3.3 Subscription Billing
- Subscriptions are billed monthly through Stripe
- Payment is automatically charged at the start of each billing period
- You can cancel your subscription at any time through your account settings
- Cancellation takes effect at the end of the current billing period
- No refunds for partial months
3.4 Free Trial
- FlowerCare Pro includes a 14-day free trial
- You can cancel anytime during the trial without being charged
- After the trial ends, your subscription will automatically convert to paid unless canceled
- Only one free trial per user
4. Refund Policy
We offer refunds under the following circumstances:
- Technical issues preventing service access (full refund within 14 days)
- Billing errors or duplicate charges (immediate refund)
- Dissatisfaction within the first 14 days of paid subscription (prorated refund)
Refunds are processed within 5-10 business days. To request a refund, contact bartzalewskidev@gmail.com with your account details and reason.
5. Acceptable Use
You agree NOT to:
- Use FlowerCare for any illegal purpose
- Attempt to reverse engineer, decompile, or hack the App
- Share your account credentials with others (except authorized family sharing)
- Upload inappropriate, offensive, or copyrighted content
- Abuse or overload our systems (e.g., automated scraping, bot usage)
- Resell or redistribute FlowerCare services
- Use the service to harass, spam, or harm others
Violation of these terms may result in immediate account suspension or termination without refund.
6. Intellectual Property
6.1 Our Property
FlowerCare retains all rights to:
- The FlowerCare app, website, and platform
- AI models, algorithms, and technology
- FlowerCare branding, logos, and trademarks
- Documentation and educational content
6.2 Your Content
You retain ownership of:
- Plant photos you upload
- Plant care data and notes you create
- Personal information in your account
By using FlowerCare, you grant us a limited license to:
- Process your photos for plant identification and health analysis
- Store and sync your data (if cloud backup is enabled)
- Use anonymized, aggregated data to improve our AI models
7. Privacy and Data Protection
Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, available at https://flower-care.top/privacy-policy.
Key privacy highlights:
- On-device processing by default (photos never leave your device unless you enable cloud backup)
- Optional cloud backup (opt-in for Pro users)
- No selling of personal data to third parties

8. Service Availability and Modifications
8.1 Availability
We strive to provide reliable service, but we cannot guarantee:
- Uninterrupted or error-free service
- That all features will work perfectly on every device
- Availability during maintenance periods
FlowerCare's core features work offline, so you can continue using the app even without internet connectivity.
8.2 Service Modifications
We reserve the right to:
- Add, modify, or discontinue features at any time
- Change subscription pricing with 30 days' notice to existing subscribers
- Update the App with bug fixes, improvements, and new features
- Perform scheduled maintenance (we'll provide notice when possible)
9. Disclaimers and Limitations of Liability
9.1 Plant Care Advice
FlowerCare provides general plant care guidance based on AI analysis and botanical databases. However:
- We are not professional horticulturists or botanists
- Plant identification and health assessments may not always be 100% accurate
- You are responsible for the care and wellbeing of your plants
- We are not liable for plant damage, death, or any resulting losses
- Always use your own judgment and consult professionals for valuable or rare plants
9.2 Service "As-Is"
FlowerCare is provided "as is" without warranties of any kind, either express or implied, including but not limited to:
- Merchantability
- Fitness for a particular purpose
- Non-infringement
- Accuracy of information
9.3 Limitation of Liability
To the maximum extent permitted by law, FlowerCare and its creators shall not be liable for:
- Indirect, incidental, or consequential damages
- Loss of data, profits, or business opportunities
- Damages exceeding the amount you paid for FlowerCare Pro in the past 12 months
Some jurisdictions do not allow limitation of liability, so these limitations may not apply to you.
10. Third-Party Services
FlowerCare integrates with third-party services:
- Stripe for payment processing
- Google OAuth for authentication
- Resend for transactional emails
- MongoDB for data storage
These services have their own terms and privacy policies. We are not responsible for their practices or any issues arising from their services.
11. Family Sharing
FlowerCare Pro includes family sharing, which allows you to:
- Share your plant collection with household members
- Grant view and edit access to shared users
- Revoke access at any time
When using family sharing:
- You are responsible for the actions of users you grant access to
- Shared users must have their own FlowerCare accounts
- Shared users must comply with these Terms
12. Termination
12.1 By You
You may terminate your account at any time by:
- Canceling your subscription through account settings
- Contacting support to request account deletion
- All data will be deleted in accordance with our Privacy Policy
12.2 By Us
We may suspend or terminate your account if:
- You violate these Terms
- You engage in fraudulent or abusive behavior
- We discontinue the service (with 30 days' notice)
- Required by law
13. Governing Law and Disputes
These Terms are governed by the laws of the United States.
Any disputes arising from these Terms or your use of FlowerCare shall be resolved through:
- Good faith negotiation first
- Binding arbitration if negotiation fails
- Small claims court (if eligible)
You agree to waive any right to a jury trial or class action lawsuit.
14. Updates to These Terms
We may update these Terms from time to time to reflect:
- Changes in our services or features
- Legal or regulatory requirements
- User feedback and improvements
When we make significant changes:
- We will update the "Last Updated" date at the top
- We will notify you via email
- Continued use of FlowerCare after changes constitutes acceptance

16. Miscellaneous

No Waiver: Our failure to enforce any provision does not waive our right to enforce it later.
